I want to quickly start off
with a correction to my story on RJB Telecom last week. I had the facts
wrong and this is actually good news for all paysite owners. My regular
preamble will be after story #1
|||||||||||||||||||||||||||||||||||||||||||||||
I OWE A BIG BIG APOLOGY TO
RJB TELECOM
This week I received an email from Bob Botto of RJB Telecom. I believe
I misunderstood the facts and was confused my a semi-misleading statement
from the FTC website. Bob sent me some great info so I want to share
our emails to get this corrected right off the bat. The GOOD NEWS is
that there has been no precident created for sending a confirming email
for paysite sign ups.
<emails>
Bob Botto of RJB Telcom Inc.
writes:
Andy, Your reference to the FTC case vs RJB and the requirements of
RJB are
incorrect. RJB was NOT required to do anything further than we were
already doing before the FTC stepped in with their ludicrous
accusations. We have NOT been required by the FTC or any other agency
to
ask members for a confirmation to renew membership. What the FTC asked
was
that certain information CONTINUE to be included in the confirmation
e-mail
which is sent out upon the initial charge (trial). Some examples are
a
customer service link, sitename, name appearing on credit card statement
etc.
There were no precedents established here, except for the fact that
the
action should have never been filed in the first place. If you would
like
to get your facts correct, perhaps next time you should ask.
Andy Dunn writes:
Bob, I am terribly sorry and will print this email (if this is ok with
you) and issue a formal apology. I read the web stories and was just
writing what I read in the following paragraph from url
www.ftc.gov/opa/2001/09/rjb1.htm
Quote from FTC page
"Under the terms of the settlement, consumers who access the Web
sites in the future will be sent an e-mail confirming their agreement
to purchase RJB's adult services."
If you give me your number
I would like to call and apologize and I would like to allow you to
add anything you wish to add to your comments to the very top story
in this weeks letter since these are events that effect all webmasters
in porn and non porn on billing.
Bob Botto of RJB Telcom Inc. writes:
All that quote says is that we will send a confirming e-mail of their
purchase. It doesn't say subsequent billing or anything else.
It becomes tiring after all this time, that people fail to take the
time to
get the story straight. It started with the FTC action and has continued
throughout.
The FTC press release was
misleading and actually made it sound like they
made us do things that we weren't already doing.
I have attached a press release
that RJB released in response to the
inaccurate and misleading FTC press release. The FTC release had a lot
of
spin on it in a futile attempt for them to look like they archived
something is a case which had no basis.
You can print whatever you like...no call is necessary.
</emails>
I was glad Bob wrote in since
it is clear that I had misrepresented the facts stemming from the confusing
FTC press release. Here is the press release from RJB regarding the
settlement
<press release from RJB
TELCOM>
Last week, the Federal Trade
Commission issued a provocative press release announcing that RJB Telcom,
Inc. and its principals, Richard (RB) and Bob Botto, had agreed to resolve
the October 2000 lawsuit brought by the FTC. The FTC's press release
was misleading and deceptive in several material respects. The press
release incorrectly stated that RJB crammed and illegally billed consumers'
credit cards and phone bills without their authorization and implied
that RJB had not promptly issued credits or sent out confirming e-mails
to customers. This is simply untrue. From the start of this litigation,
RJB has adamantly denied any illegal or deceptive conduct, and the settlement
with the FTC specifically states that there has been no admission or
finding of liability. Further, although the FTC staff conducted an exhaustive
investigation into the operations of RJB, searching for evidence to
support its complaint, it found no evidence that RJB defrauded consumers
out of a single dime.
RJB is disappointed, but
not surprised with FTC's inaccurate press release. Regrettably, inaccuracy
has been the hallmark of the FTC's work on this case. The FTC's own
complaint and declarations were riddled with inaccurate and unsubstantiated
representations from consumers and the FTC's investigator. The press
release continued this pattern, inaccurately alleging that RJB operated
web sites that provided free "teaser" visits and illegally
billed consumers. This is simply not true.
Under the terms of the Final
Injunction RJB Telcom, Inc. (1) did not pay any fine or restitution,
(2) continues with the same fraud detection and prevention methods that
it employed prior to the FTC lawsuit and (3) continues the same billing
methods that it employed in the past. Nevertheless, the FTC still will
not admit that its case was completely devoid of merit.
However, RJB believes that the Final Injunction speaks for itself. It
is highly unusual in a case of this type for the FTC not to require
substantial monetary payments. The FTC's decision not to seek these
remedies demonstrates the weakness of the FTC's allegations against
RJB. Further, the Final Injunction allows RJB to conduct its business
in the same above board and honest manner that it did prior to the FTC
lawsuit.
</press release>
RJB has handled this legal
matter with the FTC like professionals and have shown the feds that
many adult sites make an honest living. If you are looking for a new
affiliate program, check out the one from the company that fought the
feds and one. They have been around for years and have always paid...even
when times got tough. They pay $24 to $46 a sign-up and even pay $60
on "Monday Mania!"
www.maxcash.com
www.maximumcash.com/frameindex.html
|||||||||||||||||||||||||||||||||||||||||||||||
It looks like their is absolutely
no legal precident set for comfirmation emails at this time and it also
looks like the FTC had a hard time finding anything wrong with the business
practices of RJB. I think this is great news for all adult sites. It
has been yet another busy week. My folks flew home yesterday and said
that the Los Angeles and Toronto airports were smooth and they hit no
major holdups. I continue to read the news at the "Times OF India"
timesofindia.indiatimes.com/
and hope for the best. The whole world is on edge and every person and
business is cautious which slows the world economy to a crawl. I have
a theory that this may actualy lead to a banner christmas season online.
Mall shopping is way down...I can see a scenerio where we all do 90%
of our christmas shopping online and it is a HUGE record setting internet
sales seasons. We will have to see if this holds true. :)
I am once again trying to
print the newsletter a few hours early since once again my wednesday
is jam packed full of appointments tomorrow. This weeks newsletter has
some cool tricks and stories. For the newbies, I answer the classic
"how do I break into porn?"...I get this question maybe once
every couple of weeks and is usually something like "how do I make
more money" or "what am I doing wrong". This is a great
set of questions and most of you old timers know I generally approach
the issue from the side of "traffic". There is also some great
TGP tests and stories this week. A couple more webmasters have sent
in their results using some of the various script tools.
If you have ever wondered
how to make your search engine the defualt one in IE, then get ready
as I hack apart google's and tell you how to do this on your own.
This and even more! on with

WEBSITE PLAYS HARDBALL WITH
PORN SITES from Bruce
Bruce sent me this great artticle and as soon as I started reading it,
flames were flying from my nose :) check it out
www.reuters.com/news_article.jhtml?type=humannews&StoryID=268536
Now this story bugs me for
several reasons:
1. only evil porn sites target non porn words. These people are as crooked
as crooked porn sites...they are targetted words that have nothing to
do with the topic. This is like a porn site targetting dictionary words
etc. We saw in last weeks letter that the FTC is not going to shutdown
and prosecute sites that do this (and I think they should). Therefore,
this stupid www.getsomereal.com should also be prosecuted
2. porn sites are literally
the pro-master black ninjas of search engine spamming. Mr. "get
some real" is like a babe in the woods! He has no ideas the level
of the game he has entered into. If he gets 5 pages ranked top 10 on
any search on a major engine, I'd shit my pants. Porn people wrote the
book on engine spamming...he is so far behind the curve that it is not
funny.
3. there is this one site
spamming engines "get some real" and there are 3 trillion,
835 billion, 43 million, 500 thousand and 42 porn sites spamming engines
with 5,000 -500,000 doors each. Mr get some real is not even a needle
in a hay stack. He is a needle in the largest hay field on earth. Again,
it is not even funny how he thinks he could dent porn.
wither he was just going
for press, or he is very clueless. :)
Bruce agrees and writes:
Exactly. Given your last few newsletters and the latest legal issues
being used to "fight" porn, I thought it was funny to see
these naive people trying to use the same illegal tactics.

EFAX
www.efax.com
I don't remember if I have ever talked about this before but I LOVE
EFAX. I have always hated fax machines and I think their days are numbered
since it is so much easier to send an email. I have been using efax
for about 2 years now and pay the monthly fee for efax plus. Here are
some of the pros and cons on using efax. First, you are given an fax
number. This has actually gotten better since I joined. My efax number
is in chicago :) I think now you can get them closer to where you live.
Actually I don't mind it since local cheapskates don't fax to me :)
Next, ANY email you write can be instantly turned into a fax. One drawback
is that efax prefers common email programs like outlook..if you use
outlook, efax is even cooler. Since I use the rarer calypso, I have
to take a second step. For me to send a fax through email...I have to
PRINT the document with the efax printer driver and then attach it to
the email. I love getting faxes in my email...it save time and paper.
I can also rebundle that fax and make an efax.exe which I can send to
email friends and they can then open the same fax in their email even
though they are not an efax member.
The one drawback to efax
is "how do you send a piece of paper". Occasionally I will
need to send a pre existing document...say you needed to send someone
proof of your driver's license. Well you would have to scan it....a
pain in the ass but I find that 9 out of ten faxes I do not need to
do this so it is a small price to pay for the efficiency of online fax
management.
Efax I think has 3 levels
of support...free, plus and corporate I think. Free is pretty cool and
plus is not that expensive. If this interests you, check it out at

RE-BILLING EVEN IF FTC CLAMPS
DOWN from seeing mole
Seeing Mole writes:
I was thinking about that there might be an end to rebilling. Does FTC
has jurisdiction all over or just on US companies? If so, in order to
overrule this, all you need to do is relocate the business offshore
to some island in the Caribbean or something.

RE-BILLING THOUGTS from Stephen
Stephen writes:
I agree with you about the 40% of the profits if not even more. And
I wonder why RJB decided to use email confirmation to rebill trial members.
I could think of easier (for the webmaster and members) and more profitable
ways like: After a members trial is up have their account locked. When
they sign in instead of getting access to the members area they get
a big bold message like:
YOUR ACCOUNT IS LOCKED BECAUSE
YOUR TRIAL IS UP.
IF YOU WANT TO CONTINUE ACCESSING THIS SITE YOU WILL BE AUTOMATICALLY
BILLED
<INSERT SOME AMOUNT HERE> PER MONTH UNTIL YOU CANCEL.
And have them agree to this.
If they agree you can start to rebill them. Maybe it was something the
FTC wanted but I think the above idea would also be good enough.

SIMPLE JAVA POP-UP SOLUTION
FOR MOUSE TRAPS from Delay
Delay writes:
Also I agree the FTC stuff is crazy and ridiculous for the most part.
You know there is a simple solution to the mouse trapping problem. Why
don't they just make microsoft disable the javascript code routines
that enable popups in the first place or atleast put an option in their
browser (One programmer could do that in a day max) . I haven't seen
a good use of popups since they came out. While I dislike them; there
are already tons of third party solutions to prevent them. I would much
rather see people just use the free software that is available than
the FTC to create some interpretation of a law to deal with it. The
only thing I would agree with them on is the pagejacking issue. This
is only because search engines seem unable to combat this through any
technological solution that can maintain the integrity of their search
results.

time consuming bitch to keep updated with all the appropriate tgp info.
But there of course is a better option than updating by hand. There
is a site run by a guy named Vince called tgswupdates.com The service
Vince offers is absolutely critical to obtain if you intend to keep

takes about ten minutes plus the time to upload any new recip images.

INTERNET CONNECTION SHARING
from Zig
Zig writes:
just a quick note to let you know that ICS "internet connection
sharing", is built into win98 as well, atleast the "SE"
version. I recently set this up for a 6 user small office network for
them all to share e-mail and browse the web from 1 machine with a standard
56k modem. it's a lil pokey as they all share the same 56k connect,
but it works well for e-mail, and broadband like dsl is not yet avail
in thier area yet. The ics "server" is an old win98se celeron
box, the workstations are a mix of win98 se boxes and a couple winME
boxes. Some people seem to like programs like sygate and wingate to
do the same thing because of "percieved" security options
built into these 3rd party solutions, dial-up or broadband. Thing that
I see more often though is that if they are not set up correctly, your
actually more at risk than with just plain old ics. this is why most
irc networks actually probe your box for that software for open holes
and k-line you untill you fix them before you can use your thier services....:)
personally, I like cheap
and functional. ICS is already there for free and works well to get
the job done, adding a simple firewall like zone alarm to the mix is
reasonable protection for the average joe and is fairly easy to use
for the less eggheaded people, and is fairly cheap cash wise. on a second
note, along the same thread. I've never played with it, but 98se and
up are supposed to have an option to simultaneously use 2 phone lines
with a modem attached to each...sort of an "make your own 100k
circuit" type of thing. I believe you mentioned it once in one
of your newsletter a year or 2 ago. I've never tried it, but do you
know anybody that has? If so, do they actually manage a 100k circuit...or
is just a "load balanced" 56k?

about a 112k connection, mine averaged around a hundred. Win98 and above
supports multiple modems. Until I could get cable this is what I used,
I had isdn for a couple years and it wasn't any better than the multilinked
modems.

NON PORN SUCCESS STORY IN
SOFTWARE SALES from Leo
Leo writes:
Seeing all the stuff we talked about in print is neat. Hear is something
that I am confused about. There seams to be a general understanding
that one of the big reasons that people promote adult sites is because
of the high rate of conversion as comparied to other service's or product
sales. Everyone talks about how that it is easier to get people to buy
porn than software or widgits or anything elese and that is the reason
that most adult webmasters are in this business. After a lot of looking
at stat's on my regular stuff I sell versus the adult stuff I promote
I would have to say that is not true. I have tried promoting just about
every kind or type of site in the adult industry there is and I find
it easier to sell computer software than signup's for adult sites. I
got my first adult site about 2 year's ago and I built it myself with
a cool url but made no money then I went with hot signup programs and
found the same thing true. Basically what I am asking you is if everyone
is hot to promote adult sites becaus 70% of people on the Internet view
porn and all the adult webmasters say the "conversion ratio is
better then what gives? I run my traffic to about 10 diferent websites
that I market and almost every day I sell software or other service
but no porn? Im kinda confused on this. A few times I got pissed and
spent the entire day and night running all my traffic to adult sites
leaving all the other stuff alone and still no bucks???
Guru-O-Gif writes:
I was curious on what software Leo was selling. I wrote him back and
he had this great info to ad
Leo writes:
the number 1 seller that I sell is spy or security software. there is
some neat software you can buy that will find out information about
anyone and it is very developed and not a toy by any means. i sell a
lot of it and I get an ungodly conversion ratio for clicks to sales.
If I had the ability to run as much traffic as some peole run to adult
sites I would be rich in a year. I will give you the main url for "Net
Detective" so you can go and look at it
www.supersnoop007.com
That is my direct link to the coprate site where you can instantly download
the software. I had three sites up to promote this product but because
of traffic theft and all I went to useing direct "redirect"
to corprate where things are secure. The company is solid and pay's
on time and I find that the software is very much in demand and sell's
well. So anyway this is a good one for the book Andy because it is ten
times easier to sell this type of product than porn or at least it is
to me,go figure. Let me know what you think,( oh by the way even though
this product sell's well for me it doesent pay a lot, I get about 33%
of the sale or $11 bucks per sale).

HOW DO I BRAKE INTO PORN?
from Tom
Tom writes:
Well im sorta of new and sorta of not I have a paid site www.va2k.net
I shoot most my content not top content like the big boys Im having
problems getting traffic I make tons of tgp's free sites etc... I get
about 9k a week and maybe a few signups a month with the signups they
are staying and I chat with them and update and everything. I really
love it and love to be able to create sites and bring them to life.
Hell Im not looking to get rich man i put in at a min of 16 hrs a day
and sometimes i have been up working 48hrs I have read and read and
read till tears come out my eyes and still nothing. Is there anything
you or anyone you know that can help me brake into this business and
a make a little more money.
Guru-O-Gif writes:
well there is no easy answer. I always believe the key to porn and most
sites is traffic. TGP traffic is generally very watery...so 9000 TGP
hits might be like 1000 regular. If you are working on your site 16
hours a day, I ask you "what do you do in those 16 hours?".
My guess is the answer is that you add some content, change how this
thing looks over here, adjust some text over there...etc. If you have
a site, I have always believe you must spend 90% of all working hours
lokking for traffic. If you are not pouding the pavement for traffic
every day, it is tough. When I tell people this and they try it, they
say "this is boring...I hate looking for traffic....I like working
on my site and I like porn". Porn is about traffic...plain and
simple. It has to be your complete focus.
I then tell people...to get
traffic, try maybe ten different things...not one like just TGP posting.
Try and learn and try at least ten methods to generate traffic. Maybe
one a week for ten week. Then at the end of those ten weeks, evaluate
and decide which method you liked the best and did well for your site.
Now focus on that one method and become a complete expert. Do that one
method and only that one and become the king of that traffic method.
Here is an example...search engines...some new webmasters think you
sumbit a page or two and you are done....the top pros have spent years
developing their craft...using hundreds of domains, cloaking, submission
scripts, page creation scripts etc. Each field of traffic collection
requires expertise since you are competing with 500,000 adult webmasters
al chasing the same buck.
The tough news is that the
easy traffic is gone and has been gone for a couple years. It takes
more work each month to get the same traffic and sing-up rates. My favorite
approach was always to try and find newer or unexplored methods. Then
write custom scripts and try to exploit some situation. I always like
to be digging for gold in a new area..just because I enjoy that sort
of thing...but others prefer old tried and true methods that they can
compete in
It has always been my belief
that if you focus on traffic, and not tits, you will go much further
in this business. I used to say "I know a lot of broke photoshop
experts and I know a lot of rich traffic masters".
Tom writes:
I go to message boards I submit I read and ask for help most of them
people are newbies as my self. Hell Ill be willing to do anything at
this point to break in
Guru-O-Gif writes:
spend your time asking people what is their best way of getting traffic
to their site. Some will talk and some won't. Then ask the script they
use and exactly how they get those hits. Spend your time asking webmasters
how they exactly get their hits. These are the things I talk with my
ICQ buddies all day...sharing traffic ideas and script ideas.

BEAR STORY LINK from Lanus
Lanus writes:
Hiya Andy,
. Did you left out the bear story on purpose or have you forgotten to
post the URL? If you still have it, please send me the url. =)
Guru-O-Gif:
Hey Lanus! I wanted to post the story but it is their front page which
changes eer day so the stary was gone and no way to find it since they
don't archive. I thought since it was gone that the story would be less
funny with the link...here is the link for today's northern news. Today
the events seems more normal :)

7 HABITS OF SUCCESSFUL DOTCOMS
I read this interesting article in Business2.0 this week and most of
it I agree with. Mainstream sites are finally seeing the light. Stay
small, hire tech crazed late night geeks, and buy the big guys for pennies
on the dollar when they go under. An interesting read

5 IE KEYBOARD SHORTCUTS I
DID NOT KNOW
I decided to hold down the CTRL key and try the alphabet using IE to
see some of the hidden commands. Then I found out there are websites
with all the IE keyboard shortcuts. Here are 5 that I thought were cool.
You may already know some or all of them. These were all pretty well
news to me and are saving me time from clicking
CTRL I - show favorites down left
CTRL H - show history dwn left
STRL E - show search down left
CTRL D - add to favorites
CTRL B - organize favorites
and here is a great little
command I found for windows which I can't do since I use the happy hacker
keyboard and I don't have that wierd window key. Hold down the Windows
key and hit D and you get everything minimized and down to your clean
desktop...a great time saver.

MAKE YOUR SEARCH ENGINE THE
DEFAULT
I always hate when sites force this on me and I get their goofy goto
search engine BS in my IE search button. I decided to se how they do
it and there is a polite way. If you run any sort of search engine,
you might consider asking user if they "want to make this your
default engine". I found the could by accident while fiddling with
the google page that does this. Go here and look in the IE section
www.google.com/options/defaults.html#default
You can OPEN the link for
IE and it switched your default search button OR you can download it
and crack it out and see stuff like this. I will make up a search engine...my
old domain WEBWEED will be used in this example
REGEDIT4
[HKEY_CURRENT_USER\Software\Microsoft\Internet
Explorer\Main]
"Search Page"="www.webweed.com"
"Search Bar"="www.webweed.com/ie"
[HKEY_CURRENT_USER\Software\Microsoft\Internet
Explorer\SearchURL]
""="www.webweed.com/keyword/%s"
[HKEY_LOCAL_MACHINE\SOFTWARE\Microsoft\Internet
Explorer\Search]
"SearchAssistant"="www.webweed.com/ie"
that is essentially the code.
Crack open the google one to be double sure and you will see how to
ask users if they are interested in making you their default engine.
It is interesting that you are really just redirecting the user to an
alternative mini page....here is google's

TESTING TGP SCRIPTS AND TRAFFIC
from Anonymous
One of my close ICQ pals and I have been IM-ing all week as he tests
the waters of the TGP world. Anon has tried every script known to man
and is pro-master in traffic collection so these are very interesting
results
Day 1 - Anonymous writes
1300 off of the tgp posting today maybye it just takes a while will
let ya know the results..
Day 2 - Anonymous writes
th tgp has netted 5000 views of the tgp today. But the click throughs
are like 100 to my site. So maybye they are counting 100,000 gallery
views and not clickthroughs to thier sites. only lesst than 2% click
anything so if you get 100K a day then your only getting 2K click thoughs
:(
Day 4 - Anonymous writes
The TGP is up to 15,000 a day now but Like I said before the click through
is horrid. I can see why these guys with like 400,000 traffic a day
only make $5-10K a month and that 25K I am getting is converting to
about 300 clicks a day into my actual sites I am promoting..So I can
see how basically your hosting cost on a 400K site would be a big cut
out of your profit

BUTCHER COBRA UPDATE
the car is just about done. I have been so busy working on it that I
have not had time to write about it. I was a little disappointed with
my painting. The car looks good from 2 feet away but up close it looks
rougher. I have decided I will repaint it again in the spring. I have
learnt from my mistakes. It still looks pretty good and I will have
pics and stories next week!

BOXING AND FIGHTING UPDATES
Well the UFC last week was pretty good but not great since the title
fight was switched when Vitor hurt his arm. I would give the event a
7/10. The big news was the Hopkins fight. What a fight. It was a 10/10.
HUGE. It was one of the top ten fights of all time. Hopkins named "Boxer
Of The Year". A massive upset from an underdog. It even had a rare
12th round knock out! WOW. Great stuff. This week is yet another week
of awesome match up
TYSON - SAT OCT 13
this week the infamous Mike Tyson once again steps into the ring. Mike
Tyson is a press magnet. He can sell ticket like no other fighter.

PRIDE - SAT OCT 13
This is the Japan show of mixed martial arts and it is one word "awesome".
40,000 fans in attendance and front page news the next day. This is
the cream of the crop of "no holds barred" fighting. The big
names will be Don "the predator" Frye, and Mark the "Hammer"
Coleman. Should be outstanding matchups.
